1，1776年的 独立宣言：赋予人民革命的权利

“美国独立宣言：我们认为这些真理是不言而喻的，人人生而平等，造物主赋予他们某些不可剥夺的权利，其中包括生命权、自由权和追求幸福的权利。——为了确保这些权利，政府是在人类中设立的，他们的正当权力来自人民的同意，——每当任何形式的政府破坏这些目标时，人民有权改变或废除它，并建立新的政府，新的政府建立在这些原则的基础上，并以最大程度影响人民安全和幸福的形式组织权力”

“We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness.—That to secure these rights, Governments are instituted among Men, deriving their just powers from the consent of the governed,—That whenever any Form of Government becomes destructive of these ends, it is the Right of the People to alter or to abolish it, and to institute new Government, laying its foundation on such principles and organizing its powers in such form, as to them shall seem most likely to effect their Safety and Happiness”

2，1787年的美国宪法：没有直接说明州独立的问题

美国宪法没有直接说明各个州是否可以独立的问题。但是美国宪法唯一合法解读者，美国最高法院，在1868年，Texas Vs White这个案子里，明确解释：

联邦宪法“在其所有条款中都着眼于一个不可分割的州组成的不可分割的联盟。”

“in all its provisions looks to an indestructible Union, composed of indestructible States”

意思就是，大法官认为，宪法着眼于不可分割的联盟，所以各个州不能独立。但是随着时代的进步，大法官的更迭，他们对宪法的理解可能会有所变化。

3，1836年的德克萨斯宪法：德克萨斯人民保有独立的权利

1845年，德克萨斯共和国加入美利坚合众国。在加入之前德克萨斯共和国有一部1836年诞生的宪法，1876年进行了一次修改，成为得州现行的得州宪法。得州宪法明确说：

”德克萨斯州是一个自由独立的州，只受美国宪法的约束，我们自由机构的维持和联邦的永久存在取决于对地方自治权利的维护，不受其他州的影响。“

"Texas is a free and independent State, subject only to the Constitution of the United States, and the maintenance of our free institutions and the perpetuity of the Union depend upon the preservation of the right of local self-government, unimpaired to all the States.“

”一切政治权力都属于人民，所有自由政府都建立在人民的权威之上，并为人民的利益而建立。得克萨斯州人民的信仰是承诺维护共和政体，并且仅受此限制，他们在任何时候都拥有不可剥夺的权利，以他们认为的方式改变、改革或废除他们的政府。“

”All political power is inherent in the people, and all free governments are founded on their authority, and instituted for their benefit. The faith of the people of Texas stands pledged to the preservation of a republican form of government, and, subject to this limitation only, they have at all times the inalienable right to alter, reform or abolish their government in such manner as they may think expedient.“

4，德克萨斯独立的法理基础和可行性路径

（1）修改美国宪法，允许州独立：这需要大法官重新解读宪法，或者通过宪法修正案，这需要75%州同意。这个难度很大，基本不可能。

（2）德克萨斯人民公投，认为根据德克萨斯宪法，美利坚合众国联邦政府跟德克萨斯人民的自由和幸福背道而驰，德克萨斯人民有权利改变政府形式，要求脱离联邦，争取独立。这个难度也很大，因为大多数得州人民还没有达成这个共识。不过如果美国继续撕裂，多数得州人民完全有可能达成这个共识。最终通过公投独立。

（3）根据独立宣言，得州人民保有革命的权利。不过这代表着战争流血，将是美国第二次内战。
